Sergeant Clayton Hughes reports that Officers from the Palm Desert Police Department responded to the area of Monterey Ave, north of Frank Sinatra, in the city of Palm Desert, reference a possible traffic collision.  Officers arrived and found a Red Chevrolet truck facing southbound in the northbound lanes.  A second vehicle, a white BMW, found 400 yards north on Monterey, was also involved.

Dilip Samaranayake, 33 from Cathedral City, was seen speeding northbound on Monterey. DUI Palm Desert Police Sept. 30, 2018During the course of the investigation, it was revealed the driver of the BMW, identified as Dilip Samaranayake, 33 from Cathedral City, was seen speeding northbound on Monterey.  His vehicle collided with the truck, causing it to spin and lose control.

Police say that It appears Samaranayake did not initially stop after the collision, but the damage to his vehicle was such that it was no longer drivable. It was also determined that Samaranayake was apparently driving under the influence of alcohol.

He was arrested and a McNealy warrant was issued for a blood test. Samaranayake was taken to a local hospital for an OK to book and subsequently booked at the county jail in Indio.

Jose Jimenez, 64 of Coachella, was driving in the area when he collided with another vehicle.

Police say that on September 28, 2018, at 5:32 p.m., Coachella Police Officers responded a report of a traffic collision at the intersection of Avenue 52 and Van Buren Street in Coachella. The investigation revealed Jose Jimenez, 64 of Coachella, was driving in the area when he collided with another vehicle.

The other vehicle driver was injured as a result of the collision. The injuries were considered non-life threatening. Jimenez was arrested for driving while under the influence of alcohol and transported to a local hospital, as a precaution, prior to being booked into the Indio Jail.

New York State Police are investigating a two-car motor vehicle crash that occurred on October 2, 2018, at approximately 6:30 p.m. on State Route 55 in the town of Bethel. Trooper Brandon Smith, of State Police Roscoe, was traveling east on State Route 55 operating a 2013 Ford Explorer, when a 1994 Jeep Cherokee, being operated by Jesse VanEps, age 18, of Eldred, NY was traveling west on State Route 55.

New York State Police report that Trooper Smith observed the jeep drift off the north shoulder and ultimately reenters the eastbound lane that Trooper Smith is traveling in and attempted took evasive action but was unable to avoid the Jeep Cherokee and was struck head-on injuring both drivers.

Trooper Smith was transported to Catskill Regional Medical Center where he was treated for non-life-threatening injuries. VanEps was also transported to Catskill Regional Medical Center and was treated for non-life-threatening injuries

VanEps was charged with Driving While Ability Impaired by drugs (DWAI Drugs) and released on an appearance ticket returnable to the Town of Bethel Court on October 9, 2018, at 5 p.m.

Shelley Rose was arrested Nov. 20, 2018, by the Lauderdale County Sheriff’s Department for her fourth offense felony DUI. She was released from the county detention center on a $10,000 bond about eight hours later.

Lauderdale County Chief Deputy Ward Calhoun said deputies arrested the 48-year-old Rose after the department received calls about the possibly intoxicated driver of a Dodge Caravan. Witnesses said Rose allegedly drove off the roadway and sideswiped a concrete parking barrier.

 After she bailed out of the Lauderdale Detention Center, records show the Ellisville Police Department in Jones County arrested Rose the next day, on Nov. 21, on a public drunkenness charge. Ellisville is about an hour south of Meridian on I-59.

Rose was released without bail later that night, according to the Jones County Sheriff’s Department website.

Less than two days later, Rose was heading north on I-59 when her Dodge Caravan collided head-on into Bright’s Saturn Ion and Vincent’s Nissan Altima.  A southbound Honda CRV then crashed into the Saturn and rolled over into the wood line, according to the Mississippi Highway Patrol. The agency is investigating the crash.

Turnage, who was preparing Thanksgiving dinner when he was called to the crash scene, said several witnesses who saw Rose driving the wrong way called 911, hoping to prevent an accident. But it was too late.

In Mississippi, a third DUI is a felony for anyone with two convictions if the first two DUI charges occurred within the previous five years. A third offense carries a sentence of one to five years.

Last year, the law changed to make a fourth offense, no matter the time period involved, a felony punishable by a minimum prison sentence of two years, with a maximum of 10.

Still, some in law enforcement say their hands are tied by the slowness of the court system in putting these cases together. And getting information from jurisdictions where previous DUI offenses have occurred is still a challenge, Lauderdale County Sheriff Billie Sollie said.

“In these cases, there’s a lot of post-incident reports to be conducted. Part of the problem is getting these cases for the prosecution. There can be multiple counties and jurisdictions involved and it’s not easy getting that information through the courts,” he said. MORE

Evan Stewart killed when standing next to his wrecked Honda; Andrew Adams suspected of DUI

Bartholomew County- Indiana State Police report that on Nov. 30, 2018, at approximately 9:30 pm, the Indiana State Police began investigating a two-vehicle crash that occurred in northern Bartholomew County that claimed the life of a Shelbyville, Indiana man.

The initial investigation by Trp. Korry Clark, Indiana State Police-Versailles Crash Reconstruction Team, indicated that a 2003 Honda Accord being driven by Evan Stewart, 27, Shelbyville, Indiana was traveling eastbound on County Road 1000 North near Base Road. Police suspect that Stewart was driving while impaired.

Stewart’s vehicle left the roadway before striking a concrete barrier. The vehicle then overturned before coming to rest in the roadway.

Evidence at the scene indicates that Stewart exited the vehicle and was standing in the roadway near his vehicle when he was struck by an eastbound 2002 Chevrolet truck being driven by Andrew Adams, 25, Columbus, Indiana. Adams vehicle also struck Stewart’s vehicle that was stationary in the roadway.

Stewart sustained fatal injuries in the second collision. He was pronounced deceased at the scene by the Bartholomew County Coroner’s Office. Adams was not injured in the collision.

A third vehicle was reportedly at the scene when the second crash occurred although the occupants of that vehicle left the scene prior to being identified. The Indiana State Police would like to speak to the occupants of that vehicle. Anyone with information about this crash is urged to call the Indiana State Police-Versailles Post at (812)689-5000.

Toxicology tests on both Stewart and Adams are pending at this time. Alcohol is suspected to be a factor in both crashes.

The Stewart family has been notified.

Trp. Clark was assisted by troopers from the Versailles and Indianapolis Districts, Bartholomew County Sheriff’s Department, Shelby County Sheriff’s Department, Shelby County EMS, Flatrock Fire Department, Bartholomew County, and Columbus Collision Towing Services.

David S. Sterling charged with DUI fatal death on July 12, 2018, of Markia Ivy Madison County Illinois.

The Madison County Sheriff’s Office, according to Capt. T. Mike Dixon, on Thursday, July 12, 2018, at approximately 8:37 p.m., the Madison County Sheriff’s Office responded to a traffic accident, at the intersection of Wanda Road and New Poag Road, involving a motorcycle and a vehicle. The driver of the vehicle, David S. Sterling, 50, of 5501 N. State Route 159, Edwardsville, Illinois, was taken into custody at the scene for suspicious of Driving Under the Influence of Alcohol (DUI).

The driver of the motorcycle, Markia A. Ivy, 35, of Edwardsville was airlifted from the scene to a St. Louis area hospital, where she, unfortunately, died as a result of injuries received in the crash.

Blood and Urine samples were obtained from David Sterling and submitted to the Illinois State Police Crime Lab for analysis. He was processed into the Madison County Jail but released pending toxicological analysis, as well further investigations into the contributing factors that led to the accident. The Metro East Crash Assistance Team (M.E.C.A.T.) was activated to conduct an accident reconstruction investigation.

On Nov. 28, 2018, the investigation findings were presented to a representative of the Madison County State’s Attorney’s Office. A Criminal Information was prepared by the State’s Attorney’s Office and signed by the Honorable Judge Schroeder, charging Sterling with:

• Aggravated Driving With a Blood Alcohol Level of .08 or More Resulting in Death 
• Aggravated Driving Under the Influence of Alcohol Resulting in Death
• Reckless Homicide
• Unlawful Use of an Electronic Device

The Unlawful Use of an Electronic Device relates to evidence developed in the investigation indicating Sterling was actively using a cell phone at the time of the accident.

Sterling turned himself into the Madison County Sheriff’s Office Wednesday evening, after the charges were issued, and is being held in lieu of $100,000.00 Bond.

She was very active in her son’s life Spiritually, Emotionally, Academically & Socially. Markia was Malik’s best cheerleader on and off the field but especially when he played baseball with the Orange Sox Baseball Team of Edwardsville where he is an outstanding player of several positions.

Markia graduated from Edwardsville Senior High School in 2001. She was a member of The Church of God in Christ Congregational in Edwardsville, IL where she served in several capacities in the past. Markia was a very soft-spoken, gentle-hearted person. She was the proud business owner of Euphoric Beauty, a beauty supply store, located in Edwardsville.

Markia loved spending time with her son and supporting him in any way she could. She enjoyed hanging out with family & friends, singing, riding her motorcycle, working, fishing, camping and spending time with their Boxer, Miko Patrick. She was a very outgoing person and enjoyed making great memories for and with family and friends. Markia had a special love for children and they all loved her.

Single Vehicle fatal crash on Holland Loop Rd. – Josephine County (Photo) – 11/29/18

On Wednesday, November 28, 2018, at approximately 7:30 PM Oregon State Police and emergency personnel responded to the report of a single-vehicle crash on Holland Loop Rd. near milepost 3.

Preliminary investigation revealed that a Toyota Tacoma PU, operated by John Festvog, 37, of Colfax, Iowa,  was traveling on Holland Loop Rd. when he left the roadway and struck a tree.

Festvog sustained fatal injuries in the crash and was pronounced deceased at the scene.

Speed, alcohol, and lack of safety belt use are being investigated as factors in this crash.

Another Failure of Delaware’s Judges to protect the public; James Betts charged with 4th DUI after sending four people to the trauma unit following a head-on crash

SEAFORD, DEL.– There is little doubt that the lenient Judges in Delaware are more concerned about the excuses and whines of drunk and drugged drivers than they are about the bleeding and dying of the general public.

The Delaware State Police have arrested a Seaford man for his 4th offense DUI and multiple counts of Vehicular Assault after he was involved in a crash.

Police say that James E. Betts, 50, of Seaford, Delaware, has now been charged following his stay at a hospital.

The crash that injured Betts and his three victims in another vehicle occurred on November 20, 2018, at approximately 9:05 p.m. when Troopers were dispatched to a crash at the intersection of Stein Highway and Neals School Road involving two vehicles.

Police say that a Subaru Forester was traveling eastbound on Stein Highway and entered into the westbound lane striking a Ford Explorer nearly head-on.

Betts was the operator of the Forester and was transported to the Nanticoke Memorial Hospital with serious injuries.  Troopers located drug paraphernalia inside of the vehicle.

The operator of the Explorer, a 28-year-old male from Maryland and his 27-year-old female passenger sustained injuries and were transported to the Nanticoke Memorial Hospital. Two children ages 7 and 5, who were seated in the rear of the vehicle sustained major injuries and were also transported to the Nanticoke Memorial Hospital.  The 7-year-old was later transferred to the A.I. DuPont Hospital.

Police say that a computer check revealed that Betts had three previous DUI arrests making this his fourth offense. On November 30, 2018, Betts was charged with the following:

 

  • 4th Offense Driving a Vehicle Under the Influence
  • Vehicular Assault First Degree (2 counts)
  • Vehicular Assault Second Degree (2 counts)
  • Possession of Drug Paraphernalia

Betts was arraigned before the Justice of the Peace Court 2 and committed to the Sussex Correctional Institution on $13,001.00 secured bond.

BETTS GUILTY IN MARYLAND DWI ARREST

On Nov. 2, 1998, James E. Betts pleaded guilty to possession of drugs in a plea deal with the Dorchester County States Attorney in District Court in Salisbury, Md.  Betts was arrested by Natural Resources Police Officer J. Massey on June 24, 1998. THE DEAL: twenty days in jail was suspended, he was put on probation, violated his probation and was jailed on Sept. 21, 2000.

James Edward Betts Jr., of 9891 Middleford Road, Seaford, Del., was arrested on Nov. 13, 1999, for DWI – alcohol or drugs and entered a guilty plea on April 2, 2001, in a plea deal with Wicomico County States Attorney Davis R. Ruark. THE DEAL: 30 days in jail and one year of probation.

Several years later, Ruark, the prosecutor who let Betts slide with an easy plea deal, was himself arrested for DUI in Ocean City, Md. Wicomico County States Attorney Davis Ruark appeared in Ocean City District Court for trial stemming from his February 22, 2008, DUI arrest.

As the result of a plea agreement with Special Prosecutor Thomas M. Degonia, Ruark pleads guilty to DUI. In exchange for the guilty plea, the charges for handgun violation were dropped.

Retired District Court Judge John Coolahan (Baltimore County) accepted the conditions of the plea agreement and found Ruark Guilty of DUI.

Ruark was fined $500.00 plus court costs and put on unsupervised probation for one year. Ruark surrendered his handgun carry permit and was later allowed to have it reinstated. Ruark was defeated for reelection in the 2010 Democratic Primary and in 2012 moved to New Mexico where he works as a prosecutor.

LAKEPORT, CALIF. – A wild driver was arrested for DUI On December 4th at approximately 5:15 PM an off-duty Lakeport Police Department (LPD) Officer was driving a personal vehicle on Lakeshore Blvd. in the 2000 Block. The Officer saw a silver Chevrolet Impala driving south on Lakeshore Blvd and noticed it was weaving and in the bicycle lane and on the roadway shoulder. The Officer then saw the vehicle go into the opposite lane head-on toward another vehicle.

Not being able to stop the Impala, the Officer called in the vehicle and requested assistance for a drunk driver stop. While waiting for other LPD Officers, the off-duty Officer continued to follow the Impala and make observations. The Impala continued to travel dangerously and in the area of South Main Street and Lupoyoma Ave., it went through a crosswalk with a Pedestrian trying to cross.

On-duty Officers were responding in an emergency manner in order to get into position to stop the Impala and were able to stop it in the 300 Block of Lakeport Blvd.

DRIVER WAS NEARLY PICKLED!

The driver and sole occupant was identified as 44-year-old Lakeport resident Angela Fife. Officers determined that Fife was in fact intoxicated with a blood alcohol level of .40% which is 5 times .08% which is the limit where a person is presumed to be intoxicated while driving in California.

Because of her high blood alcohol content, Fife had to be taken to a local hospital for medical clearance before she could be booked into the jail.

After clearance, Fife was transported to the Lake County Jail and booked for driving under the influence, driving with .08% or more alcohol in the blood, driving with alcohol in the blood while on probation for driving under the influence of alcohol, driving with a drivers license suspended for a previous driving under the influence arrest, for having a third driving under the influence arrest within the past 10 years, for driving a vehicle not equipped with an ignition interlock device as previously ordered by a court to ensure she did not drive while under the influence and for an outstanding warrant from Sonoma County for driving with a license suspended for driving under the influence.

Lakeport California Police Chief Brad Rasmussen notes that two DUI drivers have crashed in Lakeport in the past week and urges drivers to make better decisions.

Posting on Facebook, Chief Brad Rasmussen said, “We appreciate our Officers work to remove as many intoxicated drivers as we can from our roadways and are glad this driver was not able to hurt or kill someone.”

Chief Brad Rasmussen said, “During the Thanksgiving, Christmas and New Year season we tend to see increases in drunk driving and will be increasing our efforts to arrest these persons. We ask for the public’s assistance in being alert for drunk drivers and calling 911 to report them when observed.”

On January 4, 2019, at approximately 0150 hours, Troopers from the Vermont State Police Rutland Barracks conducted a motor vehicle stop on US Route 4 in Mendon for a vehicle traveling at 105 MPH in a posted 50 MPH speed zone.

Police say that the operator was identified as Zachary W. Jepson (26) of Rutland, Vermont. Investigation revealed that Jepson was operating a motor vehicle while under the influence of alcohol. Subsequently, Jepson was arrested and processed at the Rutland State Police Barracks for DUI #2, and Grossly Negligent Operation. Jepson was issued a citation to appear at Vermont Superior Court, Criminal Division on January 22th 2019 at 1230pm.

Vermont State Police report that on January 1, 2019, at approximately 1820 hours, Vermont State Police Trooper Joseph Szarejko responded to a reported single vehicle collision located at the intersection of Vermont Route 100 and Guptil Road in the Town of Waterbury. 

Police say that a further investigation revealed that Steven Corliss, 58, of Waterbury, Vermont, lost control of his vehicle and traveled over the embankment where his vehicle became disabled. 

Police say that Trooper Szarejko learned that Corliss had operated a motor vehicle while under the influence of alcohol.  Corliss was subsequently taken into custody for suspicion of DUI and transported to the Middlesex State Police Barracks for processing. 
Corliss was fingerprinted and photographed and issued a citation to appear in Washington County District Court on January 17, 2019, at 0830 hours to answer the charge of DUI #1.


Untalented driver got a tree in one when hi-balling on Dunham Road

SUNDERLAND, VERMONT – The Vermont State Police report that on the evening of 12/30/2018, Troopers from the Shaftsbury Barracks responded to the area of Dunham Road, near the intersection of Pine Knoll, in the Town of Sunderland, Vermont, for a report of single vehicle crash.   

Police say that the investigation revealed that Vehicle # 1, operated by Obrien Ellis, 20, of Manchester, Vermont, was traveling north on Dunham Road at an excessive speed. 

Ellis became distracted and crossed into the oncoming lane of travel.  Ellis attempted to correct his direction of travel, lost control and struck a tree.  Ellis suffered injuries to his neck, back and rib as a result of the crash.  Ellis was transported to Southern Vermont Medical Center for evaluation.

Members from the Arlington Rescue Squad and Arlington Fire Department assisted at the scene.    

**UPDATE**

On 01/04/2019, Ellis was issued a citation by Trooper Nicholas J Cervero to appear in Bennington Superior Court, Criminal Division, On Monday, March 4, 2019, at 0815 AM to answer for the charges of Excessive Speed and Negligent Operation.  Additionally,  Ellis was issued Vermont Civil Violation Complaints for violations of Title 23 VSA  1031, 676, 1007 and 800(a). Police have not yet indicated if alcohol was at play in this crash.

FRESNO, Calif. (KFSN) –A 70-year-old man was hit and killed Thursday by a driver who is accused of being drunk and driving away from the collision.

Family members say Ram Bhatia was out for his nightly walk near Friant Road and Copper River Road when a black BMW slammed into him at 6:24 pm.

In a Friday news conference, Fresno Police Chief Jerry Dyer said 25-year old Matthew Chenot has been arrested for the crime.

Dyer said when detectives arrived, they found a piece of weatherstripping at the crash site and that evidence helped them determine a BMW caused the crash.

PEORIA —Korey and Rachel Korenchuk will be remembered by loved ones as a couple passionate about their two young daughters, Harley-Davidsons, and photography.
Michael “Korey” Korenchuk, 40, and Rachel Korenchuk, 30, both of 1010 Nassau Drive, were killed early Sunday after their motorcycle was struck at a stop light by an alleged drunken driver.
“They were such a beautiful couple that was very much in love,” Korey’s mother, Hilary Korenchuk, said Sunday afternoon. “My son would always kiss me hello and goodbye. He always said ‘I love you, Mom.'”

FLORIDA: Ricardo Galvan Ojeda charged with DUI by Florida Highway Patrol after he blew stop sign, slammed into a pickup and killed passenger in the truck

A man now facing serious felony charges is accused of driving under the influence Saturday, Oct. 19, 2019, for crashing into a pickup truck, killing a female passenger, according to Florida Highway Patrol.

Police say that Ricardo Galvan Ojeda was driving his Chevrolet Silverado east on Emeralda Island Road around 8:30 p.m. when he ran a stop sign and slammed into a Toyota Tacoma that was traveling south on County Road 452, said FHP spokeswoman Lt. Kim Montes.

The driver of the Tacoma, 57-year-old William Hodges of Grand Island, was critically injured and taken to Central Florida Regional Hospital, Montes said. Police say that his wife, 54-year-old Denise Hodges, died at the scene.

Ojeda told a trooper at the crash site that he was headed to a friend’s house and that he drank two beers about three hours before the collision, according to the arrest report.

The trooper noted in the report that Ojeda “seemed very confused,” mumbled as he spoke and smelled faintly of alcohol.

AUBURN, New York – U.S. Immigration and Customs Enforcement (ICE) filed a detainer Nov. 12, against a repeat immigration violator Guatemalan national Heriberto Perez-Velasquez with the Cayuga County Sheriff’s Office, where he is currently detained after being arrested for vehicular homicide. Perez-Velasquez was arrested a month earlier by New York State Police on DUI charges and released from state custody on an appearance ticket with no notification to ICE.

“Had Mr. Perez-Velasquez been detained by ICE after his October 2019, DUI arrest, a life might have been spared,” said Acting ICE Director Matt Albence. “Sanctuary jurisdictions that do not honor detainers or allow us access to jails and prisons are shielding criminal aliens from immigration enforcement and jeopardizing the lives of law-abiding citizens.”

By releasing an illegal alien with a history of driving under the influence, state authorities chose to release a serious public safety threat into the community where he is now implicated in a vehicular homicide.

“Had Mr. Perez-Velasquez been detained by ICE after his October 2019, DUI arrest, a life might have been spared,” said Acting ICE Director Matt Albence. “Sanctuary jurisdictions that do not honor detainers or allow us access to jails and prisons are shielding criminal aliens from immigration enforcement and jeopardizing the lives of law-abiding citizens.”

“The Buffalo Field Office’s robust enforcement programs are focused at making upstate New York communities safe from dangerous criminal aliens and those that look to exploit our nation’s immigration laws,” said ICE Enforcement and Removal Operations Buffalo Field Office Director Thomas Feeley. “The staff of the Buffalo Field Office works tirelessly to ensure that the upstate communities don’t become a safe haven for criminals.”

Perez-Velasquez, an illegal alien from Guatemala, was arrested by the U.S. Border Patrol on May 11, 2007, and removed to his home country later that month. Perez illegally re-entered the country at an unknown date. On Oct. 18, 2019, New York State Police arrested Perez for resisting arrest, DUI, and other charges. Perez was released from state custody on an appearance ticket and ICE was never notified.

On Nov. 10, 2019, the Cayuga County Sheriff’s Office arrested Perez for vehicular manslaughter, driving while intoxicated, and leaving the scene of a personal injury accident. On Nov. 12, 2019, ICE lodged a detainer and warrant of removal with the sheriff’s office on Perez.

New York State policy severely limits state and local law enforcement cooperation with ICE and requires a judicial warrant to honor most ICE detainers.

Perez was released from state custody on an appearance ticket and ICE was never notified.

Under the Immigration and Nationality Act as passed by Congress, ICE detainers, removal orders issued by federal immigration judges, and ICE immigration enforcement in general, is conducted under civil law. The “judicial warrant” demand only applies to criminal cases and does not exist for civil law matters.

In Fiscal Year 2018, the Buffalo Field Office made 1,582 arrests in the 48-county region – approximately 80 percent of those individuals either had a prior criminal conviction or came into ICE custody pursuant to their criminal arrest on pending charges. These statistics make clear that the agency conducts targeted enforcement focused first on criminals and public safety threats.

About Detainers

Under federal law, ICE has the authority to lodge immigration detainers with law enforcement partners who have custody of individuals arrested on criminal charges and who ICE has probable cause to believe are removable aliens. The detainer form asks the other law enforcement agency to notify ICE in advance of release and to maintain custody of the alien for a brief period of time so that ICE can take custody of that person in a safe and secure setting upon release from that agency’s custody. Yet, across the United States, several jurisdictions refuse to honor detainers and instead choose to willingly release criminal offenders back into their local communities where they are free to offend.

When law enforcement agencies fail to honor immigration detainers and release a criminal alien onto the streets, it negatively impacts public safety.

Sanctuary Policies Put Public Safety at Risk

  • Sanctuary policies leave ICE with no choice but to increase enforcement in neighborhoods and workplaces to locate and arrest these persons while they are at-large – increasing the likelihood that other individuals previously not targeted for arrest will be taken into ICE custody.
  • It is safer for everyone if ICE takes custody of an alien in the controlled environment of another law enforcement agency as opposed to visiting an alien’s residence, place of work, or other public area. Arresting a criminal in the safety, security, and privacy of a jail is always the best option.
  • When law enforcement agencies don’t honor ICE detainers, these individuals, who often have significant criminal histories, are released onto the street, presenting a potential public safety threat

GENERAL NARRATIVE
On September 1, 2019, at approximately 5:15 AM, Kingsport Police Patrol Officers responded to a motor vehicle collision on westbound Interstate 26 near mile-marker 6 (Rock Springs Road exit) in Kingsport. Based on the seriousness of the injuries to those involved, the K.P.D. Traffic Unit was called to the scene to investigate.

Their initial findings at the time were as follows: A dark blue 2008 Honda Accord 4-door sedan, driven and solely occupied by Margaret C. Buck of Johnson City, TN, was lawfully traveling westbound on I-26 near mile marker 6.
Meanwhile, a black 2005 Mercedes C230 4-door sedan, driven and solely occupied by Zachary D. Hunt of Unicoi, TN, was unlawfully traveling the wrong way, eastbound in the westbound lanes of I-26, at the same location. The Mercedes struck the Honda in a head-on impact. Both drivers were transported to a local hospital for emergency medical treatment, Mr. Hunt with non-incapacitating injuries, but Ms. Buck with serious/incapacitating injuries. The westbound lanes of Interstate 26 were completely closed for over three hours to allow for the initial treatment and transportation of the injured, the thorough investigation of the crash, and the safe removal of any and all involved vehicles and related debris.The following day, on September 2, 2019 at approximately 9:00 PM, Margaret C. Buck succumbed to injuries sustained in the crash and died while still hospitalized. This has remained an active ongoing investigation by the K.P.D. Traffic Unit since the date of the crash. Early in the investigation, it was determined that Mr. Hunt entered Interstate 26 in his black Mercedes sedan going the wrong way (eastbound in the westbound lanes) via an I-26 exit (rather than entrance) ramp at the intersection of John B. Dennis Highway and Wilcox Drive.Based on officer observations, witness statements, and evidence found at the scene, Investigators had sufficient cause to believe that alcohol consumption by Mr. Hunt was a significant factor in the crash. A warrant was obtained for a blood sample which was in turn sent to the T.B.I Crime Lab for analysis. The results received on October 2, 2019, revealed that Mr. Hunt had a blood alcohol content (BAC) of over two and a half times the legal limit. On November 20, 2019, the facts of this case were presented to a Sullivan County Grand Jury which returned a true bill of indictment. On November 25, 2019, a capias/bench warrant was issued charging Mr. Hunt with the following:

Kingsport Police say that on the afternoon of December 4, 2019, Hunt turned himself in on the outstanding warrant, surrendering himself to authorities at the Kingsport Justice Center.
He was processed in the Kingsport City Jail and then transferred to the Sullivan County Jail in Blountville where he will remain confined in lieu of a $25,000 bond.

Margaret “Cheyanne” Buck, age 47, of Johnson City, TN, died from injuries sustained in a head-on collision on I-26 on September 1, 2019.

Cheyanne was born on August 21, 1972, to Johnny Hoyt King Jr. and Vivian Ann Richards in Kingsport, TN.

Cheyanne is survived by her husband, Tim Buck; son, Brandon Buck; mother and step-dad, Ann and Wayne Richards, of Johnson City; father and step-mom, John and Catherine King, of Fairhope, Alabama; and brother, Bronson King, of Oahu, Hawaii.

She was preceded in death by her grandparents, Emory and Polly Wolfe and John and Erma King.

Cheyanne’s family will receive friends from 4:00-6:00 p.m. on Monday, September 9, 2019, at Oak Grove Baptist Church, 311 Cypress St, Mt Carmel, TN 37645. Immediately following the visitation there will be a Celebration of Life service at 6:00 p.m., under the direction of Inez Burton and James McNeill.

PENNSYLVANIA: State Police charged Leon James Charles with DUI homicide for killing his pal James Muse in I-81 crash

Pennsylvania State Police report that Leon J. Charles, of Kingston, Pa., was charged Tuesday, Dec. 3, 2019, with causing a November crash that killed his passenger in Kline Township, Schuylkill County.

Leon John Charles, 49, also of Mount Rainier, Maryland, is charged with vehicular homicide, driving under the influence and other offenses in the Nov. 28 crash resulting in the Nov. 29 death of passenger James Muse, 48, of Glen Allen, Virginia, at Lehigh Valley Hospital-Cedar Crest.

At 6 a.m. Nov. 28, 2019, Police say that Charles was driving on Interstate 81 North, near milepost 139.2, when the vehicle entered the median and rolled over. Charged also with driving with a suspended or revoked license, Charles was held under $500,000 bail.

Misdemeanor charges included possession of a controlled substance and DUI of a controlled substance, and motor vehicle code violations of driving while operating privilege is suspended or revoked, reckless driving and careless driving.

He was arraigned before on-call District Judge David Plachko, of Port Carbon, and committed to the county prison in Pottsville after failing to post $500,000 cash bail.

A passenger, James R. Muse, 48, of Glen Allen, Virginia, was injured and taken to Lehigh Valley Hospital. He died of his injuries on Nov. 29.

Leon John Charles, (DOB 07/23/1970) also has a residence at 512 Roosevelt Street, Kingston, Pa. according to Maryland court records when he was charged on May 3, 2019, in Prince Georges County Circuit Court with driving while suspended. The case was disposed of by Prince Georges County States Attorney Alisha Braveboy with a plea deal resulting in a verdict of Probation Before Judgement on Aug. 9, 2019.

In a 2018 drug arrest in Prince Georges County, Md., Charles was listed as being homeless.

Leon John Charles was found guilty on Nov. 7, 2003, in Prince Georges County Circuit Court of transporting, carrying and illegally wearing a firearm as a convicted felon.  At that time, Charles was living in Suitland, Md.

She was asked to complete field sobriety exercises, Orourke became uncooperative and refused to complete field sobriety exercises. Due to the level of impairment see, she was arrested for Driving Under the Influence.

Cape Coral Police report another doozy found on 12/20/2019 around 3:00 am, Clark hit a parked vehicle in the parking lot of Seven Eleven, located at 1540 Andalusia Blvd and left the scene after being confrontational with the owner of the victim she hit.

After running the tag that the two witnesses and victim gave Cape Coral Police Officers, Officers went to Clark’s house. She was getting out of her vehicle when Officers arrived. Signs of impairment were seen.

She was asked to complete field sobriety exercises, which she did. At the completion, she was arrested for Driving Under the Influence, Driving Under the Influence Causing Property Damage and Leaving the Scene of a Traffic Crash. BAC: refused.

DUI Garrisonville Road and Dunn Drive, 12/28, 8:46 p.m. On this date, Deputy Hurt observed a vehicle in the median attempting to make a left turn. He conducted a traffic stop and made contact with the driver who was identified as Ashley Spoto, 33, of Stafford. She smelled strongly of an alcoholic beverage and her eyes were bloodshot and glassy. Field sobriety tests were conducted and a breath test was administered. She was taken into custody and incarcerated at Rappahannock Regional Jail until sober for driving under the influence.

DUI Interstate 95 Northbound, Mile Marker 143, 12/15, 2:42 a.m. On Dec. 16, 2019, Deputy Fields observed a vehicle failing to maintain its lane of travel. He subsequently conducted a traffic stop and made contact with the driver who was identified as Cortina Scroggins, 43, of Stafford. The deputy detected the strong odor of an alcoholic beverage emanating from the driver. He also observed that the driver’s eyes were bloodshot and glassy, and her speech was slurred.

A red solo cup containing an alcoholic beverage was observed in a cup holder in the driver’s side door.

Field sobriety tests were conducted. The suspect was taken into custody and incarcerated at Rappahannock Regional Jail on charges of driving under the influence, refusal, and drinking while operating a motor vehicle. 1090 Stafford Market Place, 12/14, 11:22 p.m.

Paula Groh’s great coke adventure ended in the slammer

On Dec. 16, 2019, Stafford County Sheriff Deputy Taylor responded to a drunk driver complaint. A vehicle was observed driving recklessly on Interstate 95 and was last seen in the parking lot of Target. The deputy located the vehicle and observed that it was parked across two parking spaces. The driver was slumped over and unresponsive. The deputy also observed a clear plastic jar with a white powdery substance inside. The driver then woke up and was identified as Paula Groh, 53, of Locust Grove, VA. She was dazed and lethargic and appeared unsteady on her feet when she exited the vehicle. She told deputies the white powdery substance was cocaine. She was taken into custody and incarcerated at Rappahannock Regional Jail on charges of driving under the influence and possession of controlled substances.

DUI Tech Parkway, 12/13, 2:42 a.m. On this date, Deputy Richardson was dispatched to a drunk driver complaint. A witness observed the suspected drunk driver hit a pole and drive over a median before entering the parking lot and coming to a stop. The deputy quickly arrived on the scene and located the suspect vehicle. He observed significant damage to the front of the vehicle. The deputy then made contact with the driver who was identified as Christopher Watts, 37, of Roanoke Rapids, NC. The deputy observed what appeared to be vomit on the driver’s side door and detected the strong odor of an alcoholic beverage emanating from the driver’s person. In addition, the passenger seat was filled with liquor and beer bottles. Field sobriety tests were conducted and the breath test was refused. A search warrant for blood was executed. The suspect was taken into custody and incarcerated at Rappahannock Regional Jail until sober on charges of driving under the influence, felony vandalism, hit and run, obstruction of justice, and refusal.

DUI Warrenton Road and Burton Loop, 12/17, 7:09 p.m. On this date, Deputy Vasquez responded to reports of a reckless driver after a witness observed the vehicle strike a jersey wall and continue driving all over the roadway. The deputy located the suspect vehicle in the area of Village Parkway and initiated a traffic stop. The driver was identified as Donna Freeman, 57, of Bealeton, VA. Her speech was slurred and she was unsteady on her feet. She told deputies she had been drinking prior to driving. Field sobriety tests were conducted and a breath test administered. She was taken into custody and, while at the Magistrate’s Office, she kicked the deputy. She was incarcerated at Rappahannock Regional Jail for driving under the influence, reckless driving, obstruction of justice, assault on a law enforcement officer, and traffic offenses.

Jefferson Davis Highway and Sage Lane, 12/16, 1:24 p.m. On this date, Stafford Sheriff Deputy Jacobeen observed a vehicle stopped on the southbound side of the roadway. He activated his emergency equipment and observed the driver exit the vehicle. The driver appeared unsteady on his feet and his speech was slurred. The driver was identified as Loren Jones Jr., 38, of Washington, D.C. The deputy also detected the strong odor of an alcoholic beverage emanating from the driver’s person. During a search of the suspect’s person, a bag containing suspected cocaine was found in his pocket. Metal knuckles and a knife were also found on his person. The suspect was taken into custody and incarcerated at Rappahannock Regional Jail on a $9000.00 secured bond on charges of driving under the influence, possession of controlled substances, possession of a concealed weapon, and stopping on a highway.

Towne Center Drive, 12/15, 10:12 p.m. On this date, Stafford Sheriff Deputy Martin observed a vehicle drive over the curb and through the grass in the area of Carlos O’Kelly’s. The driver was identified as Kyle David Lewis, 20, of Centreville, VA and the passenger as Sophia Bojokles, 19, of Stafford. There was also a juvenile in the vehicle. Field sobriety tests were conducted and a search warrant for blood was executed. A search of several bags in the vehicle yielded a substance consistent with marijuana. Lewis and Bojokles were taken into custody and incarcerated at Rappahannock Regional Jail on unsecured bonds. Lewis was charged with driving under the influence, possession of marijuana, and contributing to the delinquency of a minor. Bojokles was charged with possession of marijuana and contributing to the delinquency of a minor. The juvenile was released to a family member.

The Stafford County Sheriff reports that at the intersection of Centreport Parkway and Mountain View Road, on Dec. 8, 2019, at 4:25 a.m. On this date, Stafford County Sheriff Deputy Whitt responded to a reported disabled vehicle. The vehicle had driven off the road and struck two guardrails before coming to a stop in the middle of the lane of travel. Upon arrival, the deputy made contact with the driver who had exited the vehicle and was walking around. The deputy detected the odor of an alcoholic beverage and marijuana emanating from the driver. In addition, the driver’s eyes were bloodshot and glassy, and he was unsteady on his feet. The deputy observed a beer can in the passenger seat area. Field sobriety tests were conducted and a preliminary breath test was administered. A substance consistent with marijuana was located during a search of the vehicle. Jowan Edwards, 26, of Richmond, VA was taken into custody and incarcerated at Rappahannock Regional Jail until sober on charges of driving under the influence, possession of marijuana, no driver’s license, drinking while operating a motor vehicle, and reckless driving.

The deputy located the suspect vehicle and observed it drifting outside of its lane of travel. He conducted a traffic stop and made contact with the driver who smelled strongly of an alcoholic beverage. The driver was identified as Steven Mikelson, 29, of Stafford. The driver also had glassy eyes and slurred speech. Field sobriety tests were conducted. The suspect was taken into custody and incarcerated at Rappahannock Regional Jail for driving under the influence, refusal, and a traffic lane violation.

On Nov. 28, 2019, at 1:15 am, Deputy Ahern observed a vehicle traveling well below the posted speed limit. He conducted a traffic stop and made contact with the driver who was identified as Marshae Bashir Jones, 53, of Stafford. The deputy detected the odor of an alcoholic beverage emanating from the vehicle. Field sobriety tests were conducted and a preliminary breath test was administered. The suspect was taken into custody and incarcerated at Rappahannock Regional Jail for driving under the influence and impeding traffic.

7-Eleven, 2337 Garrisonville Road, 2:38 a.m. On this date, Deputy Houde responded to reports of a drunk driver who was observed stumbling into the store and then returning to his vehicle and falling asleep behind the wheel. The deputy located the suspect in the driver’s seat of the vehicle looking down. The deputy then made contact with the driver who was identified as Martin James Cauble, 37, of Stafford. The driver smelled strongly of an alcoholic beverage and his eyes were red and glassy. He told deputies he drove from around the corner approximately 15 minutes before they arrived. The suspect refused the breath test and when deputies attempted to execute a search warrant for blood at the hospital, the suspect resisted by thrashing around and yelling. He was taken into custody and incarcerated at Rappahannock Regional Jail for driving under the influence, refusal, and obstruction of justice
