The driver, 23-year-old Elizabeth Cheyenne Hefner, was booked into the Multnomah County Jail on multiple charges including Unlawful Use of a Vehicle, Attempt to Elude by Vehicle and Recklessly Endangering Another Person.

Portland Police Bureau officers arrested the driver of a stolen car after she rammed into a patrol car to evade capture. Two others in the vehicle were arrested on unrelated warrants.

On Wednesday, June 28, 2017, at 4:05 p.m., Central Precinct officers spotted a stolen car being driven northbound on Southwest 2nd Avenue near Washington Street. Additional officers responded to assist and at Southwest 10th Avenue and Burnside Street, officers used police cars in an attempt to box in the driver.

As officers approached the driver’s side of the vehicle, the driver put the car into gear. Officers discharged pepper spray into the vehicle, but the driver was able to ram her way past an unoccupied police car and sped away northbound on 10th Avenue. Officers could see that the vehicle was occupied by the female driver and several male passengers.

Officers pursued the driver for several blocks but, after determining that no officers were injured in the ramming, terminated the pursuit due to the suspect’s dangerous driving.

In the area of Northwest 26th Avenue and Naito Parkway, the stolen car was found empty and officers began an area search for the suspect driver and passengers. Three male passengers were located at the McDonald’s restaurant on Northwest Yeon Avenue. The female driver was found hiding in a dumpster nearby and taken into custody without incident.

Not everyone wants to get out of their vehicle when instructed by Police.

PORTLAND, ORE. —  06/29/2017 — Investigators have learned that a 29-year-old female was driving a silver 2001 Mercedes 500 westbound on Columbia Boulevard and initiated a left turn across the eastbound lanes of traffic.

A 19-year-old female was driving a gray 2001 BMW 330 eastbound on Columbia Boulevard at the time the driver of the Mercedes turned across the lanes of traffic. The driver of the BMW collided with the passenger side of the Mercedes. In the Mercedes were two passengers, a 22-year-old male and a 23-year-old male, both of whom were killed in the crash.

The driver of the Mercedes has been identified as 29-year-old Amanda Nicole Erickson of North Portland. The two passengers that were killed in her car have been identified as 22-year-old Brandon Levison of North Portland and 23-year-old Donell Lee Wilkins of Southeast Portland.

The driver of the BMW has been identified as 19-year-old Lyabov Prokhorova of Northeast Portland.

Erickson remains in a Portland hospital recovering from serious injuries.

Once the investigation is complete, it will be forwarded to the Multnomah County District Attorney’s Office for review and consideration of criminal charges.

The driver of the Mercedes was transported to a Portland hospital where she remains being treated for serious but not life-threatening injuries. The driver of the BMW was transported to a Portland hospital as a precaution.

Preliminary indications are that the driver of the Mercedes was impaired by alcohol while the driver of the BMW was driving with a suspended license.

Both vehicles were towed as evidence.

Drivers impaired by alcohol or drugs injure and kill thousands of people every year. People consuming alcohol or drugs are urged not to get behind the wheel and should have a sober driver or utilize taxis, rideshare companies or transit so everyone is safe on our streets.

DUI Driver Aaron Dennehy Got Pole-In-One

PORTLAND, ORE. — 06/29/2017 — On Tuesday, June 27, 2017, at 12:29 a.m., East Precinct officers responded to the report of a single vehicle crash at Southeast 68th Avenue and Duke Street. 9-1-1 callers reported that a driver crashed into a power pole causing significant damage and that the suspect was attempting to drive away.

Officers arrived in the area and contacted the driver in the suspect vehicle approximately two blocks from the initial crash location. Officers developed probable cause that the driver was impaired by alcohol and he was taken into custody without incident.

The driver, 38-year-old Aaron Dennehy, was booked into the Multnomah County Jail on charges of Driving Under the Influence of Intoxicants (DUII), Reckless Driving, and Failure to Perform the Duties of a Driver (Hit and Run).

Portland General Electric (PGE) responded to the area to repair the damaged pole and power lines.

Boozing Andrew McLauglin Decided He Was Too Drunk To Drive So He Would Take The Bus; Parked His Truck on Bus Shelter

Andrew McLaughlin was arrested and booked into the Multnomah County Jail on charges of Driving Under the Influence of Intoxicants. Police say cool cat Andrew walked away from wreckage like he was riding a bus.

PORTLAND, ORE. — 06/29/2017 — On Thursday, June 29, 2017, at 12:32 a.m., an East Precinct officer responding to an emergency call was driving on Southeast Powell Boulevard near Southeast 50th Avenue when the officer saw the driver of a white truck driving at a high rate of speed eastbound on Powell Boulevard. The officer saw the driver crash into a TriMet bus shelter and concrete barrier.

The driver got out of the vehicle and started walking away from the crash, along with a passenger who also got out of the vehicle.

Officers stopped the driver and determined that he was impaired by alcohol. The driver, 28-year-old Andrew McLaughlin, was arrested and booked into the Multnomah County Jail on charges of Driving Under the Influence of Intoxicants (DUII), Reckless Driving, Recklessly Endangering Another Person, Failure to Perform the Duties of a Driver (Hit and Run), and Criminal Mischief in the Second Degree (two counts).

The passenger was also intoxicated and taken to a sobering facility (The Drunk Tank).

Oregon: State Police say alcohol at play in death of infant;  US 97 crash caused by Brandon Shaw failing to yield

07/01/2017 — Oregon State Police report that on June 30, 2017, at approximately 4:55 pm, Oregon State Police, and emergency personnel from Jefferson County responded to a fatal motor vehicle collision on US 97 near milepost 105, Culver Highway Junction.

Preliminary investigation revealed that a white 2012 Ford Escape, operated by Brandon SHAW, 26, of Culver, was traveling northbound on US 97 near Culver Highway Junction. Brandon SHAW attempted to negotiate a left turn onto Culver Highway and turned in the path of a southbound white 2015 Ford F750.

The white Ford F750, operated by Douglas DEAN JR, age 41, of Redmond, attempted to avoid the Ford Escape and struck the passenger side of the Ford Escape. The Ford Escape came to rest on its side.

The 9-month-old infant passenger of the Ford Escape suffered fatal injuries and was pronounced deceased at the scene after life-saving measures were performed by medical personnel. Brandon SHAW was transported by air ambulance to St. Charles Medical Center in Redmond. Douglas DEAN JR was not injured as a result of the collision.

Safety restraints were utilized and alcohol is determined to be a contributing factor.

OSP was assisted by Jefferson County Sheriff’s Office, Jefferson County Fire Department, LifeFlight, and the Oregon Department of Transportation.

The Washington State Patrol reports that a family is getting the news this Fourth of July holiday weekend that their family member was killed in a drunk driving crash on July 1, 2017, that took place at 1:0o pm on Rt. 108 six miles east of McCleary, in Mason County, Washington.

Driving the 2002 Chevy Silverado pickup in which the booze and or drug cruise took place was Todd V. Jones, 25, of Salkum, Washington. Jones was taken to Harborview Hospital for the treatment of injuries he sustained when he piloted his truck at a high rate of speed and failed to negotiate a turn, went out of control and struck a tree.

A female passenger, identified as Morgan I. Hite, 28, of Akron, Indiana was injured and taken to Mason General for treatment. She was wearing a seatbelt, reports Trooper M. Niemann. 

Charges of vehicular homicide and vehicular assault are pending against Todd Jones.  Police are withholding the name of the person Jones killed until the next of kin has been informed.

LOS ANGELES, CALIF. — 07/02/2017 —  Byoung Mi, 49, of Cypress, Calif., was arrested by the California Highway Patrol on suspicion of drunk driving after he fatally struck a motorist who decided that walking on a freeway at 2:10 am was a good idea.  and rear-ended his car on the 110 Freeway Sunday near downtown Los Angeles, officials said.

Police say that Reyes Lazaro had stopped his 1999 BMW in the number one lane of the 110 Freeway on Sunday morning near the downtown of Los Angeles.

The fatal crash occurred on the northbound freeway at 23rd Street, the California Highway Patrol reported.

When Lazaro took his stroll on the highway, police say that a 2003 Honda Accord was traveling at the legal speed limit when it smashed into Lazaro and his car, according to the CHP. Lazaro, a resident of Culver City, was pronounced dead at the scene.

Byung Mi was arrested on suspicion of driving under the influence of alcohol causing injury.

The CHP reported that Lazaro’s next of kin had been notified of his death at about 6 a.m.

The CHP’s Central Los Angeles office asked anyone who saw the crash to call them at (213) 744-2331.

LAS VEGAS, NEVADA — 07/02/2017 —  Las Vegas Metro Police Detectives N. Hansbarger, J. Bangle, and P. Solomon are investigating the fatal crash involving a DUI driver, according to Sgt. R. Stauffer.
Police report that on July 1st, 2017, at approximately 4:46 AM, a pickup truck and a minivan fatal traffic collision occurred at the intersection of Jones Boulevard and Hacienda Avenue.
Witness statements and evidence at the scene indicate a blue 2005 Dodge Caravan was traveling southbound on Jones Blvd as a black 2003 Chevrolet Silverado 1500 pickup was traveling westbound on Hacienda Avenue. As the Dodge minivan entered the intersection, the front of the Chevrolet pickup made contact with the left side of the Dodge minivan causing the Dodge to rotate counterclockwise and leave the roadway, coming to rest against a wooden utility pole.
Police say that the collision caused the Chevrolet pickup to overturn as it continued westbound. The Chevrolet pickup came to rest on its top in the eastbound lanes of Hacienda Avenue.

The 55-year-old female driver of the Dodge minivan, not yet identified by police who are waiting to notify the next of kin, was transported to UMC Trauma where she was declared deceased by attending medical personnel.

The male driver of the Chevrolet pickup, Alfredo Vazquez ­Orozco, 30, of Las Vegas, had a minor injury and was transported to UMC Trauma and displayed signs of impairment. He was released after medical treatment and booked into the Clark County Detention Center for DUI Involving Death.

This marks the 73rd traffic-related fatality in LVMPD’s jurisdiction for 2017. This collision remains under investigation by the LVMPD Collision Investigation Division.

Double trailer rig driver Michael Buterbaugh smashed into Subaru on I-5; Edward Chambers dead; DUI homicide charged

07/03/2017 — Washington State Patrol reports that on July 2, 2017, at 11: 46 pm, a tractor-trailer struck a 1993 Subaru while northbound on Interstate 5 at Exit 216 Avenue in Thurston County, Wa., resulting in the death of the driver of the car. Edward P. Chambers, 80, was using his seatbelt when his vehicle was hit by a Peterbilt tractor and double trailer operated by Michael L. Buterbaugh, 36, of Yelm, Wa., causing the car to go out of control and land in a ditch.

Chambers was pronounced dead by the Tacoma County Medical Examiner. His passenger, Scott R. Anderson, 19, of Hillsborough, Ore., was treated and released from St. Peter Hospital.

The investigation is pending as well as charges, Washington State Patrol Trooper S. Jones stated that alcohol and or drugs are involved in the crash.

Trooper Brooke Bova sent a Tweet at 1:34 a.m. that the truck driver was in custody for vehicular homicide.

The driver had pulled to the shoulder of the road after the passenger in his vehicle reported that the car was overheating, troopers with the Washington State Patrol say.

St. John the Baptist Parish Sheriff’s Deputy Injured in I-10 Crash by Impaired Driver


St. John the Baptist Parish  Louisiana State Police report that on July 3, 2017,  shortly after 5:00 am, a hit and run crash was reported on I-10 west at mile post 210.8. During the course of investigation, a St. John the Baptist Parish Sheriff’s Deputy’s vehicle was impacted by an impaired driver, later identified as 29-year-old David Earl McGirt of Baton Rouge, LA. The St. John the Baptist Parish Sheriff’s Deputy was injured as a result of the crash and airlifted to University Medical Center Level 1 Trauma Center with moderate injuries.

Preliminary investigation revealed that a 2016 Toyota Corolla was traveling on I-10 west at the 210.8-mile post and was sideswiped by an unknown vehicle that fled the scene. The driver of the Toyota Corolla sustained minor injuries during the crash and was later transported to a local hospital.

The Corolla was stopped in the left lane and the initial first responder on the scene was a St. Charles Parish Sheriff’s Deputy, who stopped his vehicle behind the Corolla with his emergency lights activated. Moments later, a St. John the Baptist Parish Sheriff’s Deputy arrived on the scene and parked his unit partially on the left shoulder and left lane with emergency lights activated. While investigating the hit and run, the St. John the Baptist Parish Sheriff’s Deputy returned to his vehicle to retrieve a medical kit; he was standing outside of his driver’s door leaning into his unit. At that time, a Toyota Venza stopped in the left lane behind the unit and was attempting to merge into the center lane.

A 2015 Kia Optima, driven by McGirt, was traveling in the left lane and struck the left rear of the Venza, continued forward and struck the rear of the St. John the Baptist Parish Sheriff’s unit. The Sheriff’s unit traveled across the three lanes of the interstate and came to rest on the right shoulder of I-10.

The officer, identified as Sgt. Stacy Lewis, was assisting with an accident on I-10 near I-55 when he was hit by a vehicle. He was airlifted to University Medical Center in New Orleans where he is being treated for a broken shoulder blade and other minor injuries. He is expected to be released today. Sgt. Lewis, an eight-year veteran of the department, was reaching into his unit to grab a first-aid kit when a car rear-ended his unit. Louisiana State Police is handling the investigation of both crashes. Below is the car that rear-ended the marked unit. The unit’s spare tire is on the ground, at the point of impact. The spare was secured underneath the unit.

 

 

The Toyota Venza received minor damage and the driver was uninjured. McGirt was uninjured and arrested for DWI, 1st Degree Vehicular Negligent Injuring and Careless Operation. He was booked into the St. John the Baptist Parish Jail.

Louisiana State Police would like to remind all motorists about the “Move Over” law. Louisiana law requires motorists to yield the right of way by making a lane change if they observe emergency vehicles or emergency hazard lights activated. If moving into another lane is not possible due to traffic, the driver must slow down to a reasonable speed when passing the emergency vehicle.

Jasper County- 07/08/2017 — Indiana State Police report that a Kentucky woman found out on July 8, 2017, that when you text and drive and drink you end up in one place and that’s jail.

Trooper Zachary Beaver responded to a single vehicle crash on I-65 northbound at the 201-mile marker (this is four miles south of the Remington/Rensselaer exit) at approximately 7:20 a.m., this Saturday, July 08, 2017, morning.  Beaver located a 2008 Mazda, driven by a Leanna Murphy, 32 0f Walton, Kentucky, that had hit the cable barrier in the median at that location.  Preliminary investigation revealed that Murphy stated she had been texting and driving when she realized her car had drifted off from the left lane, she overcorrected, swerved, and went off the roadway to the west hitting the median cable barrier.

Further investigation by Trooper Beaver showed that Murphy had also been drinking/impaired.  Murphy tested a .22% Blood Alcohol Content (B.A.C.) almost three times over the legal limit (.08% B.A.C.) in Indiana.

Murphy was taken to the Jasper County Jail in Rensselaer where she was incarcerated and charged with:

The man police say was driving drunk and hit and killed 53-year-old Jackson resident Bob Arndt appeared in Teton County Circuit Court again Thursday afternoon.

Judge James Radda told Rudy Isla-Mejico, 41, to hire his own attorney before next Thursday when his preliminary hearing is scheduled to take place.

“I encourage you to hire an attorney before that date,” Radda said. “You can always requalify for the public defender. But based on what you testified on Monday, you don’t qualify.”

When asked if he would be able to hire an attorney, Isla-Mejico said yes.

“Pretty soon,” Isla-Mejico said in court through a translator. “I had an interview with my attorney this morning. I don’t know when exactly he’s going to come into court but I’ll talk to him.”

Isla-Mejico was charged with vehicular homicide June 30 after the Dodge pickup he was driving collided head-on with Arndt’s car, police said.

“Isla-Mejico stated he had consumed two beers,” court documents state. “Deputy [Bradley] Goering noted that Isla-Mejico’s eyes were red and that he swayed while standing.”

Investigators found open containers of tequila and beer in his truck, according to documents.

JACKSON HOLE, WY – The investigation into the collision that killed Robert (Bob) Sumner Arndt is ongoing, but many are already feeling his absence.

“He had so much promise, so much left to give. It feels like such a loss to our community,” said friend Andy Heffron, a local farmer.

Arndt was involved in a head-on collision while driving east on Highway 22 Friday night. His Porsche was hit by the driver of a pickup headed west reportedly driving in the wrong lane without headlights.

Wyoming Highway Patrol identified Rudy Isla-Mejico, of Driggs, Idaho, as the driver of the pickup. He is being held in Teton County jail on two felony charges, aggravated vehicular homicide and aggravated assault and battery, and four misdemeanors including open container, driving without headlights and driving in the wrong lane. A vehicular homicide charge, state trooper Justin Gardner explained, determines that the drivers’ actions “caused the death of another person.”

“Him being drunk, driving down the road with his headlights off, had he not done that the other person would probably be alive today,” Gardner said.   MORE

Wyoming Highway Patrol troopers were dispatched to the scene at 2:12 a.m.

They determined a 2007 sport utility vehicle was traveling eastbound on Wyoming Highway 22 behind a Porche driven by Arndt.

A pickup, without its headlights on, was traveling west in the eastbound lane of the highway.

Arndt did not see the pickup and a head-on collision occurred.

After the collision, the pickup began sliding off the south shoulder of the highway.

The SUV driver tried to take evasive action and turn his vehicle to the right but collided with the passenger side of the pickup.

Troopers identified the pickup driver as Rudy Isla-Mejico. He was arrested and is facing criminal charges for driving while under the influence and aggravated vehicular homicide.

Simon Pedro Urbino-Vasquez charged with DUI manslaughter after slaughtering his passenger in overnight booze cruise

ALEXANDRIA, VA. — The Alexandria Police Department is investigating a traffic crash that occurred on Saturday, July 8, 2017, in the 300 block of S. Henry Street.

At approximately 3:11 a.m., police responded to the area for a single vehicle crash. Initial investigation indicates Simon Pedro Urbino-Vasquez, a 27-year-old Fairfax County resident, was driving southbound on S. Henry Street when he lost control of his vehicle. The driver of the vehicle had minor injuries and refused medical treatment. Two passengers were also in the vehicle. A 24-year-old Fairfax County resident was transported to the hospital with serious injuries, and a 24-year-old Silver Spring, Md. resident died from injuries on scene. The name of the deceased will not be released until next of kin have been notified.

The driver, Urbino-Vasquez, has been charged with Vehicular Manslaughter (DUI related) and is being held without bond.

Members of the Criminal Investigations Section and Crash Reconstruction Team are investigating the collision. The investigation is ongoing. Alexandria Police ask that witnesses or people with information regarding this incident contact Detective Loren King at 703.746.6689.

Allan Willard Jones charged with DUI manslaughter for killing Aaron Thomas Williams in 2016

FORT MYERS, FLORIDA – The Florida Highway Patrol had arrested Allan Willard Jones, 66, for DUI manslaughter, as well as property damage for allegedly causing the death of Aaron Thomas Williams, 89, also of Fort Myers, in a crash that took place in November of 2016.

Jones was placed in the Lee County Sheriff’s Jail on July 12, 2017.

Police say that Williams was operating a 2007 Buick southbound on Treeline Avenue when Jones veered across the grass median strip and hit the Buick head-on, causing Williams to die. Police put the BAC of Jones 0.124 above the legal limit in Florida of 0.08.

Jones is scheduled to appear in court for an arraignment on August 14, 2017

Holliday was also charged with negligent and careless operation of the bike and driving it without lights or reflectors.

John Wilson Sterrett, 22, of 5932 Dunbar Terrace, Salisbury, Md., charged by Maryland State Trooper Frock while Sterrett was westbound on Rt. 50 at Walston Switch Road on July 2, 2017, at 7:16 pm. Sterrett was also charged with reckless driving, driving the wrong way on a one-way street, failing to obey a traffic signal along with other traffic violations.  An additional criminal charge of possession of a drug other than marijuana was also placed against Sterrett by Trooper Frock.

Sterrett was arrested by Worcester County Sheriff’s Deputy Jennifer Hall on June 4, 2013, and charged with DUI. On Aug. 12, 2013, in a plea deal with the Worcester County States Attorney, Sterrett entered a guilty plea in return for a verdict of Probation Before Judgement.  THE DEAL: No time and a $400 fine.

A 21-year-old Orosi woman involved in a DUI-related collision has died after spending nearly a week in the hospital fighting for her life.

Servando Lopez Garcia was arrested Saturday, July 8, 2017, as a suspect in a collision that killed a 13-year-old boy, Tulare police said. TULARE POLICE DEPARTMENT

Tulare police were called Saturday afternoon to Cartmill Avenue and Hillman Street after reports of a three-car collision.

When officers arrived, they found a Nissan Altima with two people seriously injured inside. Adrianna Chavez, 21, and Alejandro Chavez, 13, both of Orosi, were rushed to the hospital.

Alejandro later died from his injuries.

Police believe Servando Lopez Garcia, 49, of Visalia, was driving under the influence when he slammed into the Altima.

Garcia was arrested on suspicion of vehicular homicide, driving under the influence causing injury, failure to have an ignition interlock device, and driving on a suspended license.

Garcia, who had a previous DUI, is expected back in court on Wednesday. MORE

An inmate’s latest request for relief from a prison sentence for driving drunk during a 2014 fatal crash was denied by a state appeals court.

An inmate’s latest request for relief from a prison sentence for driving drunk during a 2014 fatal crash was denied by a state appeals court.

Carlos R. Garcia, now 36, is serving 19¼ to 38 years for causing a Feb. 22, 2014, crash just outside Lancaster city that killed 24-year-old Kaitlyn Berry and seriously injured her mother.

Garcia, who pleaded guilty that same year, filed a request to withdraw the plea, arguing he did not realize a judge could order consecutive sentences on the charges.

Garcia also argued his attorney misrepresented what the potential sentence could be.

The Pennsylvania Superior Court recently denied the request, finding that Garcia was aware the charges could be sentenced consecutively.

Specifically, Garcia signed paperwork regarding that and was told he faced a potential, maximum 53-year term.

Regarding Garcia’s second claim, the high court found, his attorney mentioned potential sentence terms, but Garcia was aware the sentence was fully up to the judge.

Assistant District Attorney Christine L. Wilson prosecuted the case.

Garcia’s blood-alcohol level was .144 percent shortly after the crash, and he was driving on a suspended license from a prior DUI. The legal limit for drivers in Pennsylvania is .08 percent.

Berry was killed; her mother, Lisa Stamper, was seriously hurt.

Garcia’s 7-year-old son was a passenger in his vehicle when he veered into and struck Stamper’s vehicle nearly head-on in the 1300 block of East King Street.

Manheim Township police filed charges because the crash happened in Lancaster Township.

COVENTRY, RHODE ISLAND — Kelsie Teribury, 25-year-old from Coventry was arrested and charged with Driving Under the Influence, Driving with a suspended License 3rd Offense and Obstructing an Officer in Execution of Duty.

At about 1:00 AM this morning, July 15th, the Coventry Police received a phone call that there was a female operating a vehicle at the drive-thru of Taco Bell, 784 Tiogue Ave, who appeared to be under the influence.

Patrol units responded to the area and located the vehicle as it was exiting the drive-thru. Officers stopped the vehicle in the parking lot where they then made contact with the female operator who identified herself as, Kayla Teribury. During the investigation, it was found that the female’s true identity was Kelsie Teribury.

Officers also found there was a seven-year-old child in the vehicle. DCYF was notified and a family member responded to the scene to pick up the child.

Teribury was held at the ACI as a Probation violator.

MANASSAS, VA. — Prince William County Police report the arrest of Curtis Andrew Amon for DWI on June 10, 2017, a fourth such arrest within ten years. With his driver’s permit revoked for earlier arrests, including being arrested for DWI while being ordered to use an ignition interlock, Amon was performing key aircraft airframe and engine work and inspections for various Northern Virginia charter aircraft firms.

According to his Facebook page, Amon has been working at a charter aircraft firm based in Manassas, Va., which charters small jets and twin-engine aircraft.

According to Virginia Court records in Prince William County, Curtis Andrew Amon, of Oakton, Va., was charged in Fairfax County General District Court with DWI 1st. on Nov. 14, 2010.  On Jan. 25, 2011, Amon was found guilty. He was sentenced to 30 days in jail and his driver’s license was suspended for one year with the restriction period to terminate on Jan. 24, 2012. License Is Restricted To Use To And From Work, License Is Restricted To Use To And From ASAP Meetings, License Is Restricted To Use For Medically Necessary Travel , Transport Minor Child , Court Ordered Visitation , To And From Court Ordered Facility. Court records show he was fined $300 with courts costs of $182.00.

Amon was charged with DWI 2nd offense within five years, with a blood alcohol reading over .20% on Oct. 4, 2011 – while his driver’s license was suspended for the earlier DWI. On April 30, 2012, Amon was found guilty in Fairfax County District Court and was sentenced to 90 days in jail and given unsupervised probation. Seventy-five days of the jail sentence was suspended.  Amon’s driver’s permit was suspended for three years with restrictions that allowed him to drive for medical appointments, to and from court ordered facilities, to and from work and all the time with ignition interlock. The restriction end date was set for April 29, 2015.  A fine of $500 was ordered as part of the plea deal.

According to Amon’s LinkedIn profile, he asserts in his resume that he is an FAA licensed airframe and power plant mechanic, at the same time that the Commonwealth of Virginia restricted his ability to drive motor vehicles on Virginia highways.  The FAA also lists him as an licensed mechanic.

THE FAA AND ALCOHOL

The following guidelines were issued by the FAA in regard to Pilots. While it may be logical to figure that aircraft mechanics are just as important to aircraft safety, the FAA rules apply to pilots only in regard to alcohol.

Hard Facts and Erratic Effects

Alcohol is a sedative, hypnotic, and an addicting drug that quickly impairs judgment and leads to behavior that can easily contribute to, or cause, accidents. Its toxic effects, which vary considerably from person to person, are influenced by gender, body weight, rate of consumption (time), and total amount consumed. Consider these facts:

  • The average healthy person eliminates pure alcohol at a fairly constant rate—about 1/3 to 1/2 ounces of pure alcohol per hour.
  • Even after complete elimination of all of the alcohol from the body, there are undesirable effects—hangover—that can last 48 to 72 hours following the last drink. Symptoms commonly associated with a hangover are headache, dizziness, dry mouth, stuffy nose, fatigue, upset stomach, irritability, impaired judgment, and increased sensitivity to bright light. A pilot with these symptoms would certainly not be fit to safely operate an aircraft.

Alcohol and Aviation

The majority of adverse effects produced by alcohol relate to the brain, eyes, and inner ear— three crucial organs to a pilot.

  • Brain effects include impaired reaction time, reasoning, judgment, and memory.
  • Visual symptoms include eye muscle imbalance, which leads to double vision and difficulty focusing.
  • Inner ear effects include dizziness and decreased hearing perception.

Pilots have shown impairment in their ability to perform even routine VFR flight tasks while under the influence of alcohol, regardless of individual flying experience. The number of serious errors dramatically increases as your blood alcohol level goes up. Some studies have shown diminished pilot performance with blood alcohol concentrations as low as 0.025 percent. If other variables (e.g., sleep deprivation, fatigue, medication use, altitude hypoxia, or flying at night or in bad weather) are present, the negative effects are significantly magnified.

Regulations and Recommendations

The use of alcohol and drugs by pilots is regulated by Title 14 Code of Federal Regulations section 91.17: No person may operate or attempt to operate an aircraft within eight hours of having consumed alcohol, while under the influence of alcohol, or with a blood alcohol content of 0.04 percent or greater. A more conservative approach is to wait 24 hours from the last use of alcohol before flying.

This is especially true if intoxication occurred or if you plan to fly IFR. Also, consider the effects of a hangover. Eight hours from “bottle to throttle” does not mean you are in the best physical condition to fly or that your blood alcohol concentration is below the legal limits. Time is the only real solution and, ideally, every pilot should strive for total avoidance of alcohol in planning or accomplishing a flight. Lives are at risk if you drink and fly.

BAKERSFIELD, CALIF. — Kern County District Attorney Lisa S. Green announced the filing of two charges against John George Giumarra Ill. Giumarra, 48, was charged with one felony count of hit and run (Vehicle Code section 20001) arising out of a collision where a death occurred. He was charged with one misdemeanor count of driving while impaired (Vehicle Code section 23152) with a prior misdemeanor conviction for driving while impaired. The criminal case originated from a collision that took place on January 16, 2017, on Golden State Avenue near the intersection with F Street. Angela Holder, 32, was killed in the collision.
The Bakersfield Police Department requested felony DUI charges and the felony hit and run charge. District Attorney Green explained why the felony DUI charge was not filed: “The law is absolutely clear that an individual must commit an independently unlawful act other than driving impaired, and that act must be the cause of death.

Giumarra did not commit any separate act that caused Ms. Holder’s death, therefore there was insufficient evidence to support the filing of a felony driving while impaired. A felony hit and run causing death have no similar independent unlawful act requirement, and therefore the evidence supports the filing of the hit and run.”

If convicted, Giumarra faces a maximum sentence of four years in state prison.

John Giumarra III, a member of the prominent Bakersfield farming family that runs Giumarra Vineyards Corporation, pleaded not guilty Monday to hit-and-run and DUI charges stemming from a crash in January that killed a bicyclist.

Giumarra, 48, agreed to waive time so his preliminary hearing could be scheduled for Aug. 17 instead of within 10 days. He also signed a Watson advisal acknowledging he’s been told if he drinks and drives and someone dies, as a result, he could be charged with murder.

Attorney Jeremy Brehmer said Giumarra would post bond after the hearing.

Police said Giumarra was driving in the 1600 block of Golden State Avenue when he collided with a bicyclist around 9:30 p.m. Jan. 16.

He left the scene, according to police, and was found at a Mobil station on F Street, where officers determined he was under the influence.

The bicyclist, Angela Holder, 32, died the next day at Kern Medical Center.   MORE

Services are to be held at Greenlawn Funeral Home Northeast on Saturday, February 4, 2017, from 10:00 a.m. to 2:00 p.m. All who knew her are welcome to join the family to celebrate her life.

Melinda Duncan, 56, of Coram, was arrested Tuesday, July 18, 2017, on DWI Suffolk County Police in Centereach, N. Y.

CENTEREACH, NEW YORK — Suffolk County Police report that on Tuesday, July 18, 2017, at 10:35 pm, they arrested a woman for driving while intoxicated with a child in the vehicle after she was involved in a motor vehicle crash in Centereach last night.

Sixth Precinct Patrol officers arrested and charged Duncan, 56, of Coram, New York, with Aggravated Driving While Intoxicated with a Child Passenger 15 Years or Younger (Leandra’s Law), Driving While Intoxicated and Endangering the Welfare of a Child. Duncan will be held overnight at the Fourth Precinct and will be arraigned at First District Court in Central Islip on July 19.
